Terms & Conditions – Urban Quest

These Terms & Conditions (“Terms”) govern your access to and use of the Urban Quest mobile application (the “App”), operated by Blue Pelican Digital LLC (“Company,” “we,” “us,” or “our”).

Urban Quest is a location-based interactive storytelling experience that guides users through real-world environments using GPS and multimedia content.

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

  1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App.

Some content within the App may include additional age recommendations. By using the App, you represent and warrant that you meet all applicable age requirements.

  1. App Description & Intended Use

The App provides interactive, location-based stories that unfold as users travel to real-world locations. Content is unlocked when users physically arrive at designated locations.

The App is intended for personal, non-commercial use only.

  1. Location Services Requirement
    a. Use of Location Data

The App requires access to your device’s precise location (GPS) to function.

Location data is used to:

  • Guide you to story locations
  • Trigger and unlock content upon arrival
  • Enable progression through experiences
  • Detect arrival at locations, including while the App may be running in the background

Location data may be accessed both while the App is actively in use (foreground) and in limited cases while running in the background, solely to support core functionality such as arrival detection.

We do not use location data for advertising, marketing, or tracking purposes unrelated to App functionality.


b.Disabling Location Access

If you disable location services, the App will not function as intended, and certain features will be unavailable.

  1. User Safety & Responsibility

You are solely responsible for your safety while using the App.

By using the App, you agree to:

  • Obey all local laws, traffic rules, and regulations
  • Remain aware of your surroundings at all times
  • Avoid dangerous, restricted, or private property
  • Exercise good judgment while traveling between locations

The App provides story guidance only and does not guarantee the safety, accessibility, legality, or condition of any location.

Use of the App is at your own risk.

  1. User-Generated Content

a.Content Submission

The App may allow users to create, upload, or submit content, including but not limited to stories, audio, video, images, and related materials (“User Content”).

b. Ownership Assignment

By submitting User Content through the App, you irrevocably assign and transfer all rights, title, and interest in and to such content to Blue Pelican Digital LLC, including all intellectual property rights.

You waive any claims to ownership, compensation (except as explicitly agreed in writing), or future royalties related to such content.

c. Content Restrictions

You agree not to submit content that:

  • Is unlawful, harmful, or offensive
  • Contains explicit or inappropriate material
  • Infringes on intellectual property rights of others
  • Violates any applicable laws or regulations

d. Enforcement

We reserve the right to review, remove, or refuse any User Content at our sole discretion.

  1. Purchases, Subscriptions & Payments

Certain content or features may require payment.

  • Payments on iOS devices are processed through the Apple App Store
  • Payments on Android devices are processed through Google Play
  • Purchase management is facilitated by RevenueCat

We do not collect or store full payment information.

All purchases are final except as required by Apple App Store or Google Play policies.
Refunds, cancellations, and billing issues are handled by the respective platform providers.

  1. Intellectual Property

All App content (excluding User Content prior to assignment), including stories, text, images, audio, video, software, and design, is owned by the Company or its licensors and protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works without prior written permission.

  1. User Conduct

You agree not to:

  • Use the App for unlawful purposes
  • Attempt to manipulate GPS or location-based systems
  • Reverse engineer, decompile, or interfere with the App
  • Disrupt or compromise App functionality or security

We may suspend or terminate access for violations of these Terms.

  1. Third-Party Services

The App relies on third-party services that may include:

  • Apple App Store and Google Play (payments and distribution)
  • RevenueCat (purchase infrastructure)
  • Mapping and location services (e.g., Google Maps)
  • Video platforms (e.g., YouTube)
  • Cloud and infrastructure providers (e.g., AWS, Expo)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

  1. Disclaimers

The App is provided on an “as is” and “as available” basis.

We make no warranties regarding:

  • Accuracy or availability of content
  • GPS precision or uninterrupted service
  • Safety or accessibility of real-world locations

Use of the App is at your own risk.

  1. Limitation of Liability

To the maximum extent permitted by law, Blue Pelican Digital LLC shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to:

  • Personal injury or property damage
  • Travel-related incidents
  • Loss of data or access
  • Use of or inability to use the App
  1. Indemnification

You agree to indemnify and hold harmless Blue Pelican Digital LLC from any claims, damages, or expenses arising out of your use of the App or violation of these Terms.

  1. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason.

Upon termination, your right to use the App will immediately cease.

  1. Changes to These Terms

We may update these Terms from time to time. Updates will be posted within the App or on our website with a revised effective date.

Continued use of the App constitutes acceptance of the updated Terms.

  1. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.

  1. Apple App Store Terms

If you access the App on an Apple device:

  • Apple is not a party to these Terms
  • Apple has no responsibility for the App or its content
  • Your use of the App must comply with Apple’s Licensed Application End User License Agreement (EULA)

In the event of a conflict, Apple’s EULA governs with respect to iOS usage only.
