# Terms & Conditions – Urban Quest

These Terms & Conditions (“Terms”) govern your access to and use of the Urban Quest mobile application (the “App”), operated by **Blue Pelican Digital LLC** (“we,” “us,” or “our”). The App is a location-based interactive storytelling experience that guides users through real-world locations using GPS technology, and allows certain users (“Creators”) to publish their own quests. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

## 1. Eligibility

You must be at least 13 years old (or the minimum age required by law in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement. We ask for your date of birth on a neutral age screen when you sign up to confirm your eligibility, and we do not permit account creation by anyone under 13.

## 2. App Description & Intended Use

The App provides interactive, location-based stories that unfold as users travel to specific real-world locations. Story content is unlocked when users physically arrive at designated locations, similar to a real-world escape room or guided adventure. Verified Creators may publish their own quests for other users to play, subject to these Terms and our content policies.

You agree to use the App only for personal enjoyment and, where you are an approved Creator, for the lawful publication of your own original quest content.

## 3. Location Services Requirement

### a. Use of Location Data

The App requires access to your device’s **precise location (GPS)** to function. Location data is used solely to:

– Guide you to story locations
– Trigger story content upon arrival
– Enable progression through the experience

Location data is collected while the App is in use, **including in the background while you are actively playing a quest** (so the App can detect when you reach a waypoint); background collection stops when the quest leg ends. Your precise location is not used for advertising or marketing. Free quests display ads through Google AdMob, which may use your device’s advertising identifier as described in our Privacy Policy.

### b. Disabling Location Access

If you disable location services, the App will not function as intended, and certain features or content may be unavailable.

## 4. User Safety & Responsibility

You are responsible for your own safety while using the App. By using the App, you agree to:

– Obey all local laws, traffic rules, and regulations
– Remain aware of your surroundings at all times
– Avoid dangerous, restricted, or private areas
– Use the App responsibly and at your own risk

The App provides **story guidance only** and does not guarantee safety, accessibility, or suitability of any location.

## 5. Purchases, Subscriptions & Payments

Certain content or features may require payment.

– Payments on iOS devices are processed through the **Apple App Store**
– Payments on Android devices are processed through **Google Play**
– Purchase and subscription management is handled by **RevenueCat**

We do not collect or store your full payment information. All billing, refunds, and cancellations are subject to the policies of Apple, Google, and RevenueCat.

## 6. Intellectual Property

All content within the App that is created or owned by us, including but not limited to stories, text, images, audio, video, characters, artwork, and software, is owned by us or our licensors and is protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works without prior written permission, except as expressly permitted by these Terms.

By submitting user-generated content (a “Quest” or any portion thereof) through the App or our creator tools, you grant us a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable, and transferable license to host, store, reproduce, display, perform, distribute, and modify (for technical reasons such as resizing, reformatting, or transcoding) that content, and to sublicense these rights to our service providers and distribution partners (such as the Apple App Store and Google Play) solely as needed to operate, promote, and improve the App and to make your content available to other users. This license applies to all content you submit — whether you create it using our tools or incorporate material you created or acquired beforehand, including stories, text, images, audio, video, or other works you already own or have copyrighted (for example, a previously written, copyrighted story you adapt into a Quest).

You retain ownership of your original content. You represent and warrant that you own, or have obtained all rights, licenses, consents, and permissions necessary to grant the license above for everything you submit, and that your content does not infringe or violate the intellectual-property, privacy, publicity, or other rights of any third party. If your content includes any third-party material (such as text, music, images, video, trademarks, or a person’s name, voice, or likeness), you are solely responsible for clearing all rights needed for us to use it as described in these Terms.

This license ends when you or we remove the content from the App, except for (a) copies already shared with or cached by other users and (b) copies we must retain for legal, audit, or moderation purposes.

## 7. User Conduct

You agree not to:

– Use the App for unlawful purposes
– Attempt to bypass or manipulate GPS or location-based features
– Reverse engineer, decompile, or tamper with the App
– Interfere with App security or functionality
– Use any automated system (bots, scrapers) to access the App or extract data
– Impersonate another person or misrepresent your affiliation with any person or entity

We reserve the right to suspend or terminate access for violations of these Terms.

## 8. Prohibited Content & Conduct

The App allows users to publish and consume user-generated content. To keep the community safe, the following content and behaviors are **strictly prohibited**, anywhere in the App, including in quest titles, descriptions, scene scripts, narration, uploaded images, uploaded audio or video, profile information, or any other field a user can populate:

– **Sexual content involving minors.** Any depiction, suggestion, or solicitation of sexual content involving anyone under 18 is forbidden, will be reported to law enforcement, and will result in an immediate permanent ban.
– **Sexually explicit, pornographic, or obscene content.**
– **Hate speech.** Content that promotes or incites hatred, violence, or discrimination against individuals or groups based on race, ethnicity, national origin, religion, disability, gender, gender identity, sexual orientation, age, or veteran status.
– **Harassment, bullying, threats, or intimidation** of any individual or group, including doxxing (publishing private information without consent).
– **Violence and gore.** Graphic depictions of violence, self-harm, or gore that are not contextually appropriate.
– **Illegal activity.** Promotion, facilitation, or instruction in illegal activities, including drug dealing, weapons manufacturing, fraud, theft, or unlicensed gambling.
– **Dangerous or harmful directives.** Quests that direct players to trespass on private property, enter restricted or dangerous areas, evade law enforcement, or perform any action likely to cause physical harm to themselves or others.
– **Intellectual property infringement.** Content you do not have the right to use, including copyrighted text, images, audio, video, or trademarks belonging to others.
– **Spam, scams, or deceptive content.** Including phishing attempts, pyramid schemes, fake giveaways, and content designed primarily to redirect users to external sites.
– **Malware or malicious links.** Any content that contains, links to, or attempts to deliver software designed to harm a device, account, or network.
– **Personally identifiable information** of others published without their explicit consent.
– **Impersonation** of any real person, brand, or organization.

**We reserve the right, at our sole discretion, to remove any content that violates these Terms, suspend or permanently ban any user who violates these Terms, and report illegal content and conduct to the appropriate authorities.** This applies regardless of whether the violation was identified by our moderation team or reported by a user.

## 9. User-Generated Content & Reporting

### a. Pre-publication review

All Creator-published quests are reviewed by our moderation team before they become available to other users. We may also use automated tools to flag potentially prohibited content for human review.

### b. Reporting

If you encounter content in the App that you believe violates Section 8 (Prohibited Content & Conduct), please report it. You can report content from inside the App by tapping the report icon on any quest, scene, comment, or user profile. You can also email us at **[email protected]** with the subject line “Content Report” and a link or screenshot.

### c. Action on reports

We take all reports seriously and will review and act on reports of objectionable content **within 24 hours**, including by removing offending content and, where appropriate, suspending or banning the responsible user. Egregious violations (such as sexual content involving minors) will be acted on immediately and reported to law enforcement.

### d. Blocking other users

You may block any other user from inside the App. When you block a user, their quests and any other content they publish will no longer appear in your feed, and they will be prevented from interacting with you within the App.

### e. No tolerance for abusive users

There is no tolerance for users who repeatedly publish prohibited content. We reserve the right to permanently ban any user, with or without notice, for repeated or egregious violations of Section 8.

## 10. Third-Party Services

The App may rely on third-party services, including Apple, Google, RevenueCat, and mapping or hosting providers. Your use of those services is subject to their respective terms and policies.

We are not responsible for third-party services or content.

## 11. Disclaimers

The App is provided on an “as is” and “as available” basis. We make no warranties regarding:

– Accuracy or availability of story content
– GPS precision or uninterrupted access
– Safety, accessibility, or condition of real-world locations

Use of the App is at your own risk.

## 12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from:

– Use of or inability to use the App
– Travel to or presence at any location
– Personal injury, property damage, or loss
– Content posted by other users

## 13. Indemnification

You agree to indemnify and hold harmless Blue Pelican Digital LLC and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the App, content you post, or your violation of these Terms.

## 14. Termination

We may suspend or terminate your access to the App at any time for any reason, including violation of these Terms. Upon termination, your right to use the App will cease immediately. Sections 6, 8, 11, 12, 13, and 16 survive termination.

## 15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted within the App or on our website with an updated effective date. Continued use of the App after the effective date of an update constitutes acceptance of the updated Terms. Material changes will be announced in the App or via email where appropriate.

## 16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict of law principles.

## 17. Apple App Store End User License Agreement (EULA)

If you access or use the App on an Apple device, your use of the App is also subject to Apple’s **Licensed Application End User License Agreement (EULA)**, unless we provide a custom EULA.

In the event of any conflict between these Terms and Apple’s Licensed Application EULA, Apple’s Licensed Application EULA shall govern solely with respect to your use of the App on iOS devices.

You acknowledge that Apple is not a party to these Terms and has no responsibility for the App or its content, except as required under applicable law.

## 18. Account Deletion

You may delete your account at any time. To delete your account and associated personal data, either:

– Use the in-app account deletion option in your profile settings, or
– Email **[email protected]** with the subject line “Account Deletion Request” from the email address associated with your account.

We will process your request and delete or anonymize your personal data within 30 days, except where retention is required by law or for legitimate business purposes (such as fraud prevention or financial records). Content you have published may be removed from your account but anonymized copies may persist as required for moderation, audit, or legal records.
